Terms & Conditions

Mutual Nondisclosure 

The Service Provider and Client mutually recognize that they may discuss future plans, business affairs, customer lists, financial information, job information, goals, personal information, and other private information. The Service Provider will not voluntarily communicate the Client’s information to a third party. In order to honor and protect the Service Provider’s intellectual property, the Client likewise agrees not to disclose or communicate information about the Service Provider’s practice, materials, or methods to any third parties.



Required Notification 

Should Services provided include The Emotion Code®, the Client understands that the Service Provider is an independent person/entity and that Discover Healing, Dr. Bradley Nelson, and associated staff cannot be held responsible for the Service Provider’s action and/or statements. Before The Emotion Code® can be administered the Client must accept the terms of this Agreement. Lastly, the Client understands that the Service Provider is expressly prohibited from teaching and/or training others in The Emotion Code® system and is required to differentiate between other modalities when The Emotion Code® is administered.



Release of Information 

The Service Provider engages in training and professional education to pursue and/or maintain professional credentials. This process requires the names and contact information of all clients for possible verification by various credentialing bodies. The Client’s information will be utilized strictly for the purpose of meeting these requirements. By signing this agreement, you agree to have only your name, contact information, and service dates shared with these credentialing bodies for the sole and necessary purpose of the Service Provider pursuing and/or maintaining professional credentials. No personal informational (documented or verbal) will be shared.



Confidentiality Statement and Privacy 

All (documented/verbal/personal) information, apart from terms laid out in this Agreement’s Release of Information, provided is strictly confidential and remains private unless agreed upon by the Service Provider and Client.

 

This confidentiality statement is subject to applicable laws. As such, Confidential Information does not include information that: (a) was disclosed to the Service Provider and as a result of such disclosure the Service Provider reasonably believes the Client is at risk to harm themselves or others; and/or (b) involves illegal activity. If such information is provided, the Service Provider is ethically bound to report the required information in accordance with local law.

Additionally, the service relationship is not privileged and, as such, the Service Provider/Prairie Sky Holistic LLC/Nathan Tinsley records, regarding work with individuals, can be subpoenaed.

 

Furthermore, for the practice of maintaining the highest ethical standards, topics may be anonymously and hypothetically shared with other professionals for training, supervision, mentoring, evaluation, and for the Service Provider’s professional development and/or consultation purposes. None of the client’s personal or identifying information will be shared.



Data Protection 

It is impossible to fully protect the confidentiality of information, which is transmitted electronically. This is particularly true of email and information stored on computers connected to the Internet and if you use a cordless or cell phone.



Limited Liability 

Except in the case of gross negligence or malpractice and as expressly provided in the Agreement, the Service Provider makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the services negotiated, agreed upon and rendered. The Client agrees to full release and hold harmless the Service Provider/Nathan Tinsley from and against any and all claims or liability of whatsoever kind or nature arising out of or in connection with provided Services and in no event will the Service Provider, be liable to the Client for any indirect, consequential or special damages. Notwithstanding any damages that the Client may incur, the Service Provider’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Service Provider under this Agreement for all Services rendered through and including the termination date.
